Terms and Conditions of Instrumental Hire Agreement

 

1. The Agreement

a)      This is an agreement between the Hirer (parent/guardian) and Kingston Music Service (hereinafter referred to as KMS) on behalf of the Royal Borough of Kingston.

b)      This agreement is initially for one term or year and may be extended on a termly basis thereafter.

c)      The agreement may be terminated by either party.

 

2. The Instrument

a)      KMS will provide an instrument that is in full working order, complete with accessories (i.e. bow, mouthpiece and case where appropriate). The Hirer agrees to return this instrument in the same condition – well maintained and fully functional.

b)      General defects (i.e. tarnishing, cracks, etc.) must be recorded on the hire agreement form overleaf and acknowledged by the Hirer and KMS. Any fault or defects not recorded overleaf will be repaired and the full cost will be charged to the Hirer.

c)      KMS will undertake minor repairs that may occur to the instrument within the first 30 days of hiring.

d)      All instruments on loan remain the property of the Royal Borough of Kingston, and this agreement does not pass ownership on to any other party.

e)      The only person authorised to use this instrument is the pupil stated overleaf and the KMS instrumental tutor.

f)      All instruments must be returned to the KMS office by agreement of the two parties. Failure to do so may incur a full term’s fee.

g)      The Hirer is responsible for all general maintenance costs whilst the instrument is in their care. This includes peripherals such as strings, bridges, pegs, resin, bow, hair, reeds, cork grease, pull-throughs, slide cream, valve oil, water-key corks, fuses and key pads.

h)      The Hirer is responsible for organising and paying for any repairs that may be needed using the KMS instrument repair technician. The hirer must not under any circumstances attempt to make DIY repairs.

 

3. The Hirer agrees to (during the period of hire):

a)      Take full responsibility for the care and maintenance of the instrument and report any damages to KMS immediately (as detailed above).

b)      The Hirer agrees to pay the invoice on submission at rates published by KMS (copies available from the office).

c)      Keep the instrument adequately insured against loss or damage covering all risks including fire, theft, flood and malicious damage and against all third party claims made against the Hirer or pupil. The Hirer is required to insure the instrument at the full replacement value as indicated overleaf, plus an additional sum of £50.00.

d)      It is the responsibility of the hirer to check with their insurance company that an instrument is adequately covered.
