Planning Enforcement

What is Planning Enforcement?

Planning Enforcement is a necessary and important element in the control of development. Unauthorised development of land can have consequences for public amenity and the environment generally.

Kingston Council is the statutory Local Planning Authority for the Borough. Within the Council's Planning Department there is a team dedicated to Planning Enforcement.

The Council is responsible for making sure developments in the Borough do not take place without the correct permission. If a development has been carried out without necessary permission or not in accordance with planning permission which has been granted, the Council will normally seek the voluntary co-operation of those responsible to resolve the issue, but it does have powers to force action to remedy the situation.

Kingston’s Planning Enforcement unit

Kingston’s Planning Enforcement unit deals with all reported breaches of planning control (ie all instances where something requiring planning permission has taken place, without permission being obtained).

The Planning Enforcement Section attends to all reports relating to:

  • Unauthorised built development (new buildings, extensions and alterations to existing buildings, etc.)
  • Unauthorised land uses (new types of business running from a property, a new use of land etc)
  • Building works that are not in accordance with approved plans
  • Breaches of the conditions placed on a planning permission
  • Illegal works to trees and listed buildings
  • Illegal advertisements
  • Neglected land and property that is an eyesore
