Consultation on a Special Policy on Cumulative Impact

In November 2011 the Council published a revised version of its Statement of Licensing Policy under the Licensing Act 2003. This policy incorporated a Special Policy on Cumulative Impact in relation to an area of the Kingston Town Neighbourhood.

The Effect of the Special Policy on Cumulative Impact

The Special Policy on Cumulative Impact creates a 'rebuttable presumption’ that applications for new premises licences or club premises certificates (or for variations to existing licences) made in respect of premises within the defined area will normally be refused unless the applicant can demonstrate to the satisfaction of the Licensing Authority that there will be no negative cumulative impact on the licensing objectives.

However, the ‘rebuttable presumption’ does not relieve residents, local businesses or responsible authorities of the need to make representations in relation to applications about which they have concerns regarding the promotion of one or more of the licensing objectives. Any applications that do not receive representations will automatically be granted.

The Special Policy on Cumulative Impact does not impact upon the operation of premises already licensed within the Cumulative Impact Area, unless a licence holder seeks to vary their licence in a manner that would cause negative cumulative impact. The Policy on Cumulative Impact cannot be used as a basis for the review of an existing Premises Licence or Club Premises Certificate.
