ENFORCEMENT AT 29 ACACIA GROVE NEW MALDEN pdf icon PDF 72 KB

Minutes:

A garden room has been created at 29 Acacia Road, New Malden, without planning permission having been obtained.

 

Approval was sought for enforcement action to require the removal of the outbuilding and any resultant debris within 3 months of the notice taking effect.

 

Mr John Hearsun spoke on behalf of the applicant, Ms. Fiona Doyle.

 

RESOLVED that the Head of Legal Services and Interim Head of Planning are authorised

 

1. to issue an Enforcement Notice (s) under Section 172 of the Town and Country Planning Act 1990 (as amended),

 

2. to withdraw and vary such notice (s) under S. 173 A, and in the event of non- compliance,  take action (s) by the way of prosecution under S. 179 and/or direct action under S. 178 of the Act in respect of the breach of planning control/or for injunctive relief under S. 187B.

 

Reason for decision

 

To issue notices to end the breaches of planning control.

Applications refused are for the reasons set out in the report by the Interim Head of Planning and any amended reasons are set out below.

 

There were no public speakers.

 

2 applications were withdrawn.

 

A3 (11/14743) the Scout Hall, Tadworth Avenue, New Malden, KT3 6DJ, was withdrawn due to procedural irregularities. The application needs to be reconsulted upon.

 

A5 (11/14872) 21-27 Wellington Crescent, New Malden, was withdrawn as the development also includes an adjoining site. Therefore an application to cover both sites needs to be submitted.

Minutes:

Erection of a detached 4 bedroom house with integral garage, basement and amenity space.  

 

In considering the report and the recommendation to permit, Members were of the view that The proposed development by reason of its design, position and siting to the rear of Stoke House represents an unacceptable backland development which would comprise the visual character and appearance of the area and would fail to preserve or enhance the character and appearance of the Coombe Wood Conservation Area. It was agreed to REFUSE the application for the following reasons;

 

The proposal would be contrary to policies BE11 (Design of New Buildings and Extensions), BE3 (Development in Conservation Areas), RES3 (Determination of Planning Applications) and STR6 (Conserving and Enhancing the Built Environment) of the Royal Borough of Kingston upon Thames Unitary Development Plan First Alteration. Policies DM10 (Design Requirements for New Developments) and CS8 (Character, Heritage and Design) of the LDF Core Strategy Submission Draft May 2011. Policy 3.5 (Quality and Design of Housing Developments) of the London Plan (July 2011) and Planning Policy Statement 3 (Housing).

TREE PRESERVATION ORDER OBJECTION AT 89 KINGS AVENUE, NEW MALDEN pdf icon PDF 514 KB

Minutes:

This Tree Preservation Order (TPO) protects several trees which are potentially affected by the future redevelopment of the site. 

An objection was received from the resident of 89 Kings Avenue to 2 Ash trees (T3 and T4), on the grounds that they are causing structural damage to adjacent garages and house.

 

RESOLVED that the Royal Borough of Kingston upon Thames TPO No.30 is confirmed without modifications.

 

Reason for decision

The TPO reinforces the local planning authority position requiring retention of the designated trees through the course of development and ensures the long-term continuation of the cycle of tree cover in the area.
