How to appeal against a Penalty Charge Notice (PCN)

If you believe that the PCN should not have been issued to a vehicle or under the circumstances that it should be cancelled then you should immediately appeal to the Council.

Please note that if you wish to appeal, you can only do this by writing to the Council. We are unable to cancel any PCNs over the telephone. Any challenge against a PCN must be made in writing as it constitutes your evidence against the Notice. We can however offer advice to you on whether in the circumstances you may have grounds to appeal.

If you receive a Penalty Charge Notice (PCN) that you feel was incorrectly issued, then our Representations team can advise you of the legislation under which the PCN was issued, why it was issued and explain the appeals process to you. The team can also advise you what may happen if you choose to ignore the Notice, or any of the subsequent documents you may receive.

It is in your interest to pay the Penalty Charge Notice within 14 days to receive the discount amount. If you do wish to appeal, write to us as soon as possible always quoting the PCN number and your full address. DO NOT ignore any letters you may receive from us.

The team is also responsible for processing penalties issued to vehicles travelling in bus lanes. This is enforced through Closed Circuit Television (CCTV) cameras. You can find more information on bus lanes below.

Bus Lane Enforcement

The majority of motorists don’t drive in bus lanes, however a few do. Whilst it may be a small number, they do slow down and obstruct buses.

In partnership with Transport for London (TfL) we are determined to keep bus lanes clear and ensure passengers get to their destination on time. In order to do this the bus lanes are enforced through bus mounted and road side CCTV cameras.

Unlike safety cameras, bus lane enforcement cameras don’t flash but they do record traffic in bus lanes. This means that if you enter a bus lane during enforcement hours you may receive a Penalty Charge Notice (PCN) for £120 in the post.

Bus lanes are clearly signed and lined. The words “Bus Lane” are painted in the bus lane and a thick white line shows the edge of the lane. The tarmac in the bus lane is often coloured red. The hours of operation for the bus lanes are found on blue signs at the start and along the side of the lanes. If no times are stated then the bus lane is in force at all times.

Some vehicles other than buses are allowed to travel in bus lanes. The blue plates next to the lanes show which vehicles are allowed. In Kingston these are licensed taxis and pedal cycles, as shown in the sign above. Motorcycles are allowed to travel in some bus lanes. Where this is the case, the blue plate would be similar to the one shown but with a motorcycle symbol.

The Council has a Code of Practice for the use of CCTV cameras and the video recordings.
