If you are a Leaseholder What Repairs are the Council Responsible for

The Council's responsibilities:

The Council is responsible for the repair and maintenance of the structure, exterior and shared parts in a block of flats. This includes:

  • Exterior walls
  • Roof
  • Foundation
  • Timber and joists
  • Beams
  • Chimney stacks
  • Rainwater and soil pipes
  • Sewers and drains
  • Gas, water and electricity pipes up to the flat
  • Independent heating and hot water services for leases granted before January 1988
  • Communal heating systems such as night storage heaters
  • District heating
  • Lifts
  • External decoration
  • Internal communal areas such as stairs/landings
  • Public way windows and doors
  • Communal gardens, paths, walkways and fences
  • Communal grounds and parking areas

NB: For leases granted before January 1988 deeds of variation are available to enable leaseholders to maintain their own heating and hot water services.

The leaseholder's responsibilities:

In addition to the service charge which covers communal repairs undertaken by the Council, the following repairs are your responsibility:

  • Fittings such as kitchen units and sinks
  • Floorboards
  • Internal non structural walls
  • Plaster or other surface material on interior walls and ceilings
  • Internal doors and frames
  • Toilets, baths and showers
  • Radiators, cisterns, tanks, boilers and pipes used exclusively in a flat
  • Independent heating and hot water services for leases granted with effect from January 1988
  • Gas, waterand electricity installations exclusive to the flat.
  • Fixtures, fittings and internal decorations.
  • Responsibility for any leaks or burst pipes including damage caused to other council property as a result
