On 6 April 2006 the Environmental Protection Act was amended to include artificial light as a statutory nuisance. This now enables Local Authorities to investigate and if necessary take enforcement action over nuisance caused by light.
Where we receive complaints officers will usually visit the complainants premises and make an assessment of the intrusiveness of the light and whether we are able to demonstrate statutory nuisance. This will entail taking measurements externally to affected bedroom windows and making comparisons to published guidance. The complainant may also be requested to complete a diary to demonstrate the frequency of the use of the light.
