Work Controlled by Building Regulations

Common examples of work controlled by Building Regulations for which an appropriate application must be made before work starts include:

New Building and Extensions

  • The erection of most new buildings and extensions (but see also guidance on Work Exempt from Building Regulations).
  • All loft conversions and dormer windows.
  • All new drainage or alterations to existing drainage.
  • The rebuilding of a fire-damaged building.

Alterations and Services

  • All alterations to the load-bearing parts of any controllable building.
  • All internal alterations to layout that may affect means of escape in case of fire.
  • All new structural openings for new windows and doors etc.
  • Re-roofing
  • Underpinning of all or part of a controlled building.
  • The insertion of insulation into the cavity wall of a building
  • All new or altered “controlled works or fittings” which are NOT being carried out by a registered member of a Competent Person Scheme. For example, new bathrooms, WC’s, boilers, chimneys, flues, cooling plant, air conditioning.
  • All notifiable electrical work (to dwellings) which is NOT being carried out by a registered member of a Part P Competent Person Scheme (see separate Part P guidance).
  • All replacement windows or doors which is work that is NOT being carried out by a registered member of a Competent Person Scheme such as FENSA.
  • The renovation of a ‘thermal element’ e.g. replacing a wall, floor or roof.

Changes of Use

  • Converting non-habitable parts of a building into habitable use e.g. converting a garage into a living room.
  • The increase or reduction in the number of dwellings within any building. For example, converting a house into 2 no. self-contained flats or converting a building containing flats into a single dwelling.
  • Certain changes of use of buildings. For example, office to dwelling, exempt building to non-exempt building.

This list is not exhaustive and if there is any doubt as to whether work is controlled, reference should be made to the definitions of building work and material change of use contained in Regulations 3 and 5 of the Building Regulations 2000 (as amended). Before starting work consideration should also be given as to whether or not Planning Permission is required, owner’s/landlord’s consent is necessary, and/or whether requirements under the Party Wall etc.1996 Act apply.
