Cemetery And Crematorium Regulations - Section C: Purchase And Transfer Of Graves

1. Exclusive Right of Burial in a Private Graves

The exclusive right of burial in a private grave is granted for a period of 75 years. Periods of grant may be extended up to the legal maximum for a period/fee as posted within the current table of fees.

2. Puchasing Private Graves in Reserve

Private graves may not be purchased in reserve.  However, the Borough will permit the purchase of an option to purchase [i.e. to reserve] a grave for renewable periods of two years when need is demonstrated.

3. Selection of Grave Spaces

The selection of grave spaces is subject to the approval of the Council.

4. New Vaults, Mausoleums and Brick Graves

No new vaults, mausoleums or brick graves above or below ground will be permitted without the written consent of the Bereavement Services Manager and Registrar or authorised representative.  All mausoleums must be properly constructed and thereafter finished with a suitable cladding to the satisfaction of the Council within three months of the interment.

5. Transferal of Right of Burial

The exclusive right of burial in any grave shall not be transferred or assigned without the permission of the Council.  Forms for transferring or assigning burial rights can be obtained from the cemetery office and must be completed and submitted together with the appropriate fee.

6. Purchasing Exclusive Right of Buirial for Multiple Grave Spaces

No person will be permitted to purchase the exclusive right of burial in more than two separate grave spaces without the written permission of the Council.

7. Application for Purchase of New Grave

Application for the purchase of a new grave must be made using the appropriate section on the Notice of Interment.

8. Exclusive Rights of Burial for Funeral Directors, Monumental Masons, and their Associates

Exclusive rights of burial will not be granted to a Funeral Director or monumental Mason or any Partner, Director or employee in such a firm unless satisfactory evidence is provided to the Bereavement Services Manager that the grave is for private use and not for the purpose of the business.

9. Right of Access over Grave Spaces

The Council reserves the right of access over all grave spaces and the right to temporarily remove any memorial from any grave to facilitate the digging of any adjacent grave for the purposes of interment.

10. Cremated Remains Graves

Cremated remains graves are available at Kingston cemetery.  A maximum of four interments can be accommodated in each cremated remains grave for which the exclusive right of burial will be granted for a period of 50 years. Periods of grant may be extended up to the legal maximum for a period/fee as posted within the current table of fees.

11. Private Gardens

Private Gardens are available at Kingston and Surbiton cemeteries.  A maximum of two interments can be accommodated in each garden for which the exclusive right of burial will be granted for a period of 75 years. Periods of grant may be extended up to the legal maximum for a period/fee as posted within the current table of fees.

12. Traditional Cremated Remains Graves

Traditional Cremated Remains graves are available at Kingston Cemetery. A maximum of two interments can be accommodated in each grave for which the exclusive right of burial will be granted for a period of 50 years. Periods of grant may be extended up to the legal maximum for a period/fee as posted within the current table of fees. The section is provided with pre-installed purpose designed concrete foundation the fee for which is as posted in the current table of fees.

13. Traditional Children's Graves

Traditional Children’s graves are available at Kingston Cemetery. A maximum of one interment can be accommodated in each grave for which the exclusive right of burial will be granted for a period of 75 years. Periods of grant may be extended up to the legal maximum for a period/fee as posted within the current table of fees.

14. Note Regarding these Regulations

The regulations within this section are deemed to include cremated remains graves, private gardens, traditional cremated remains graves and children’s’ graves. Periods of grant may be extended up to the legal maximum for a period/fee as posted within the current table of fees.
