The Council's Statement of Licensing Policy sets out the arrangements the Licensing Authority will normally apply and consider in carrying out its licensing functions under the Act, particularly when making decisions on relevant licence applications in respect of Premises Licences, Club Premises Certificates, Personal Licences and Temporary Event Notices.
Kingston Council has determined that it will review its licensing policy annually, and in November 2011 published a revised version of the policy incorporating a Cumulative Impact Policy for part of the Kingston Town Neighbourhood.
In addition, the revised policy incorporates Neighbourhood Specific Policies, intended to ensure that relevant and necessary measures are taken into consideration by applicants seeking to set up or extend licensed businesses within a particular Neighbourhood, recognising that more stringent controls may be necessary and appropriate in one area, but may not be so required in another
The Authority must have regard to its Statement of Licensing Policy in carrying out its functions under the Licenisng Act 2003, including when making decisions, and it is expected that applicants will also give consideration to its contents when making applications.
The Council's current Statement of Licensing Policy is available from the link below.
In additon, when carrying out its functons, the Licensing Authority is also required to have regard to the Secretary of State's Guidance issued under section 182 of the Licensing Act 2003, a copy of which is available from the link below.
